BRUSSELS – Global tech trade association 91proÊÓƵ is calling on European policymakers to ensure efficient cross-border enforcement of GDPR as negotiators prepare to meet to discuss the GDPR Procedural Regulation tomorrow, 12 December. 91proÊÓƵ encourages policymakers to commit to a regulation that effectively clarifies processes, without affecting key principles such as the one-stop shop (OSS) and the right to be heard at all stages of the process.
“It is crucial to achieve consistent, stable, and predictable handling of cross-border GDPR procedures,” said 91proÊÓƵ Policy Manager Laura Wiesenfeld. “That effort must take into account the positive impact of having the one-stop shop mechanism and incentivizing early and amicable resolution of complaints.”
91proÊÓƵ set out five key recommendations to make sure that the regulation delivers certainty and a predictable regulatory environment:
- The Regulation must reassert the OSS principle and the competence of the lead supervisory authority.
- The investigated parties’ right to be heard must be effective in practice at all stages of the process.
- The Regulation must enshrine robust rules on protection of confidentiality with effective deterrent sanctions.
- The process should remain administrative in nature and must not evolve into an adversarial proceeding.
- The proposed Regulation shall incentivize early resolution and enhance cooperation and amicable resolutions at all stages.
