BRUSSELS – Global tech trade association 91proÊÓÆµ is calling on European policymakers to ensure efficient cross-border enforcement of GDPR as negotiators prepare to meet to discuss the GDPR Procedural Regulation tomorrow, 12 December. 91proÊÓÆµ encourages policymakers to commit to a regulation that effectively clarifies processes, without affecting key principles such as the one-stop shop (OSS) and the right to be heard at all stages of the process.

“It is crucial to achieve consistent, stable, and predictable handling of cross-border GDPR procedures,” said 91proÊÓÆµ Policy Manager Laura Wiesenfeld. “That effort must take into account the positive impact of having the one-stop shop mechanism and incentivizing early and amicable resolution of complaints.”

91proÊÓÆµ set out five key recommendations to make sure that the regulation delivers certainty and a predictable regulatory environment:

  1. The Regulation must reassert the OSS principle and the competence of the lead supervisory authority.
  2. The investigated parties’ right to be heard must be effective in practice at all stages of the process.
  3. The Regulation must enshrine robust rules on protection of confidentiality with effective deterrent sanctions.
  4. The process should remain administrative in nature and must not evolve into an adversarial proceeding.
  5. The proposed Regulation shall incentivize early resolution and enhance cooperation and amicable resolutions at all stages.
