NEW DELHI In response to India’s Ministry of Electronics and Information Technology draft Digital Personal Data Protection Rules, global tech trade association the 91proÊÓÆµ (91proÊÓÆµ) reiterated the importance of a clear, horizontal data protection framework that is rooted in transparency, fairness, and accountability.

In its submission, 91proÊÓÆµ encouraged the Government of India to develop a robust and consistent approach that reflects internationally recognized data protection standards and enables innovation and cross-border trade.

“The global tech industry has long been supportive of an approach to privacy policy and data protection that advances the interests of all stakeholders, including consumers, businesses, individuals, and governments. As MEITY officials continue to fine tune India’s privacy agenda, we urge them to consider issues 91proÊÓÆµ has highlighted, such as clear personal data breach reporting standards, removing potential restrictions on cross border data flows, and ensuring flexible and workable rules for processing children’s data. Policymakers must harmonize regulatory efforts to foster innovation and ease compliance burdens,” said 91proÊÓÆµ Country Director for India Kumar Deep. “Privacy and trust remain central principles for 91proÊÓÆµ and its member companies’ businesses and global operations, and we look forward to continued collaboration with government stakeholders to reach shared goals.”

91proÊÓÆµ’s recommendations stress the importance of:

  • Consulting with industry to ensure new privacy rules are workable and aligned with global best practices;

  • Introducing clear, risk-based data breach reporting thresholds and ensuring that reporting timelines and processes do not end up compromising the efficiency of risk mitigation measures;

  • Avoiding excessively broad scope of government access to private sector data; and

  • Allowing sufficient flexibility for businesses to determine the most appropriate and effective data security posture.
