NEW DELHI – Today, global tech trade association 91proÊÓÆµ reacted to the Parliament of India’s introduction of the Digital Personal Data Protection Bill (DPDPB), a wide-ranging data protection framework, from its Country Director for India, Kumar Deep:
“India’s introduction of comprehensive privacy legislation is an important step in the government’s endeavor to develop a digital regulatory framework. We support the framework’s introduction of a clear and flexible approach to international data flows and look forward to contributing to a robust, multi-stakeholder rulemaking process to address outstanding concerns. While we appreciate the improved data flows language, we were concerned to see the removal of the deemed consent provision, which is critical to provide a basis for processing personal data to enable the proper functioning of different types of digital services. Further work is needed to ensure the framework provides clear legal grounds for businesses to process data where consent is not possible or technically feasible, such as for the prevention of fraud, ensuring high network security, and for other essential business activities.”
Last year, 91proÊÓÆµ offered recommendations to enhance the bill’s aim to protect Indian citizens' privacy while also supporting India’s economic growth and future innovation. 91proÊÓÆµ has been supportive of the establishment of an independent data protection supervisory authority in India that has the technical expertise and authority to refine and adapt rules to encourage the growth of India’s agile digital ecosystem and lead a global regulatory discussion.
